3.5. Behavioral data
In order to tailor our offers and services to you, we try to get to know you better. To do this, we process data about your behavior. Behavioral data is information about your use of our website. They can also be collected on the basis of technical data. We may also use your other interactions with us as behavioral data, and we may combine behavioral data with other information. This data then gives us information about what needs and interests you are likely to have. For this purpose, we evaluate behavioral data. 3.7. Other possible dates
Depending on the need, we can then also process the following additional data:
4. Purposes of our data processing
We process your personal data, as far as permitted, for various purposes in which we have a legitimate interest corresponding to the purpose:
On our website, we offer you the option of using a so-called social media plug-in from Facebook, Instagram, YouTube, LinkedIn to integrate functions of the respective provider on our website. These plugins are deactivated by default, but are activated when you click on the social media icon on the website. You can send requests for information and other data subject inquiries in connection with these social media providers directly to the provider concerned.
5. Online advertising techniques
We use online advertising techniques such as cookies on our website. This is how we measure the usability and success of the website and online advertising campaigns.
5.1. What are online advertising techniques such as cookies?
If we track you, we can distinguish your accesses from other users so that we can ensure the functionality of the website and carry out statistical evaluations. Each time you access a page, you are recognized as an individual visitor and can therefore be differentiated from other people, for example by the server assigning a unique identification number to your browser (this is then referred to as a so-called “cookie”). Cookies are automatically stored on your device when you visit our website. We use cookies, for example, to save settings between your visits to the website or to collect statistical, technical data.
5.2. Which cookies or online advertising techniques do we use?
We use analytics services so that we can optimize our website. In the following, we will explain how our most important analysis service providers work as examples. Other third-party providers of appropriate tools usually process personal data in a similar way.
6. Disclosure of data to other companies and other recipients
We share your personal data with service providers. This applies in particular to IT service providers, but can — where necessary — concern analysis service providers, collection service providers, credit agencies, marketing service providers, etc. Insofar as these service providers process personal data as contract processors, they are obliged to process personal data exclusively in accordance with our instructions and to take data security measures. Data can then also be disclosed to other recipients, e.g. to courts and authorities as part of legal proceedings.
In particular, we may share your personal data with other companies in the group of companies. Disclosure may be used for intra-group administration or to support the relevant group companies and their own processing purposes.
In individual cases, it is also possible that we share personal data with other third parties for their own purposes, e.g. if you have given us your consent to do so or if we are required or entitled to do so by law.
7. Personal data abroad
Recipients of data (e.g. other companies or authorities) are not only in Switzerland. This applies in particular to group companies and certain service providers who participate in development or offer SaaS solutions. These may also be located outside the European Economic Area (EEA) and Switzerland, in particular the USA, Kosovo, i.e. also in other countries around the world.
For example, we can transfer data to authorities abroad if we are legally obliged to do so, but consider the risk to be very low because our service providers do not primarily work with your personal data, but focus on the development and maintenance of the software. If errors occur, it may happen that real data (in very rare cases personal data) must be displayed during live broadcasts in order to better understand the facts. Not all countries outside Switzerland and the EEA have the same level of data protection as in Switzerland. We therefore compensate for the lower level of protection through appropriate contracts, in particular the so-called standard contractual clauses issued by the European Commission and recognized by the Swiss Data Protection and Information Commissioner (EDÖB).
In certain cases, we can transfer data in accordance with data protection requirements even without these contracts, e.g. if you have consented to a specific data disclosure or if the disclosure is necessary for contract processing or enforcement of legal claims or for overriding public interests.
8. Duration of data processing
We store and process your personal data as long as it is necessary for the purpose of processing (in the case of data in connection with contracts, this is usually for the duration of the contractual relationship), as long as we have a legitimate interest in storing the data (e.g. to enforce legal claims or to ensure IT security) and as long as data is subject to a legal storage obligation (for example, there is a ten-year retention period for certain data, which we must comply with). We destroy or anonymize your personal data after the storage or processing period has elapsed, unless legal or contractual obligations prohibit this.
9. Rights of data subjects
You have certain rights under applicable data protection law so that you can obtain further information about and influence our data processing. In particular, these are the following rights:
If you assert your rights as a data subject, we must verify your identity (this is done, for example, by sending a copy of an identity document). The listed rights of data subjects are then subject to legal requirements and restrictions. This means that the exercise of rights is not always possible in full. For example, we must continue to process your personal data in order to fulfill an order with you, to protect our own legitimate interests or to comply with legal obligations. To the extent permitted by law (e.g. to protect the privacy of third parties and to protect your own interests worthy of protection, such as the existence of trade secrets), we may restrict or deny your exercise of rights. It should also be mentioned that you also have the option of contacting the competent data protection authority with your request.
10. Status of the privacy policy
This privacy policy is up to date and dated 12.10.2023.
